This Privacy Policy is an electronic record in the form of an electronic contract being compliant and construed in accordance with data protection laws of the applicable jurisdictions.

1. Definitions

“User(s)” shall mean individuals that use/access the Website and/or avails the services through the Website;

Customer” shall mean an entity, organization, individual which has subscribed to the services;

Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Information;

“Personal Information” means information that can be used to identify the User, including but not limited to individual’s full name, mobile number, residential address, email address, company name, employee number and designation;

Processor” means a natural or legal person, public authority, agency, or other body which processes Personal Information on behalf of the Controller.

When the Company receives Personal Information from its Customer, the Company acts as a Processor and shall process such Personal Information as per the instructions received by the Controller. We may collect your Personal Information in the following cases:

i. Personal Information collected when you contact us/ request a demo:

When you contact us, request for a demo through our Website and/or write to us on our email, you may provide us your Personal Information, including but not limited to first name, last name, company name, company email address, designation, contact number.

ii. Personal Information collected for recruitment purposes:

We may collect certain Personal Information from you if you apply for a job at our Company through the careers page on our Website, including but not limited to the candidate’s name, email address, contact number, resume/CV and any other information that you provide to us.

iii. Social media platforms:

We may also collect, store and use your Personal Information when you access social media pages operated by us on Facebook, YouTube, Instagram, Twitter, and/or LinkedIn.

3. Cookies

We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. Tracking tools also used are beacons, tags and scripts to collect and track information and to improve and analyze our Website. You may choose to disable cookies through your browser settings. 4. Accuracy of information

The User undertakes that he shall be solely responsible for the accuracy, correctness, or truthfulness of the Personal Information shared with us whether of its own or any third party. In the event the User is sharing any Personal Information on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal Information with the Company, obtained a written consent from such third party and the Company shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Information shall be subject to the terms and conditions of this Privacy Policy.

5. Processing of Personal Information by us on behalf of the Customers:

This section concerns the Personal Information of the User collected by the Customer through the services offered on the Website, and such collection may be facilitated by us:

i. The Company as a Processor: The Customer sets the purpose and means of processing of such Personal Information. We process such Personal Information only on behalf of and on the instructions of the Customer and for the purposes of rendering services to the Customer.

ii. Customer Privacy Policy: If you are the User of the Website and your Personal Information was shared with us by the Customer, the privacy policy of the Customer, on whose behalf we collect and process the Personal Information, will apply. This means that any enquiry, request, objection or complaint that you as a User may have in connection with the collection and/or processing of Personal Information that forms part of your Website usage should be addressed to and resolved by the Customer.

iii. Personal Information: We may process Personal Information of the users of the Website, including but not limited to the name, email address, contact number, account details, details of support tickets.

    The Customer has complete control over the Personal Information and the Company processes the Personal Information on the Customer’s behalf.

iv. Customer Responsibility: The Customer represents that it has acquired all necessary consents and/or relies on other appropriate legal basis for the processing of Personal Information of end-Users. Customer confirms that end-Users have been informed that their Personal Information is transferred to the Company as a processor and other third parties used by the Company for the provision of Services.

We will process the Personal Information for as long as we provide services to the Customer and the Customer maintains active accounts of such Users.

6. Use of Personal Information

We use the Personal Information for the following purposes:

  1. to inform you about our Offerings and to respond to your requests;
  2. for creation or development of business intelligence or data analytics in relation to the Offerings provided by us (for this purpose we may share the Personal Information with certain software or tools available online);
  3. to improve the Offerings;
  4. to process job applications (if you apply for a position with our organization);
  5. to maintain and manage our Website;
  6. to manage our relationship with you;
  7. for internal record keeping; and 
  8. to comply with our legal or statutory obligations.

7. Disclosures

We will retain User’s Personal Information as long as it is required to be retained for the purpose of provision of the services on our Website. We may retain and use User’s Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We have implemented sufficient security measures to protect Personal Information. We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online. All Personal Information is stored on third party cloud servers, accessible only to authorized personnel. Although we provide appropriate firewalls and protections, we cannot guarantee the security of Personal Information transmitted, as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, and technical issues is possible, and we will take necessary measures to mitigate such events. 

10. Your Rights

You have the right to access your Personal Information in our possession, the right to have us rectify or modify any such Personal Information, the right to have us erase/delete your Personal Information, the right to restrict us from processing such Personal Information, the right to object to our use of your Personal Information, and withdraw consent to process your Personal Information. If you withdraw your consent, we may not be able to provide certain products or services to you. Depending on the nature of the request, we may ask you to complete a Personal Information request form or seek certain details to verify the request. 11. Information for EU and UK Visitors 

Residents of the European Union (“EU”) and United Kingdom (“UK”) should note that this Privacy Policy has been updated in accordance with the requirements of the EU General Data Protection Regulation (the “GDPR”) and the UK GDPR, the United Kingdom Data Protection Act 2018, the Privacy and Electronic Communications Regulations, and any regulation superseding any of the foregoing (“UK Privacy Laws”). As per the provisions of the GDPR and UK Privacy Laws we shall be considered the Controllers of the Personal information collected as a result of your use / access of the Platform and Processors of the Personal information collected as a result of your use / access of the Services.

Legal Basis (for EU residents and UK residents): We will not process your Personal Information without a lawful basis to do so. We will process your Personal Information only on the legal bases of consent, contract, or on the basis of our legitimate interests, provided that such interests are not overridden by your privacy rights and interests.

Transfer of your personal information across borders (for EU Residents): The Personal Information we collect (of EU and UK residents) is stored on servers located in the EU region. Personal Information might be processed outside the EU and UK. We collect and transfer Personal Information outside the EU and UK in accordance with the provisions of the GDPR and UK Privacy Laws.   8. you have the right to lodge a complaint with a data protection authority. 

UK residents have the right to make a complaint at any time to the Information Commissioner’s Office (“ICO”), the UK supervisory authority for data protection issues (www.ico.org.uk). 12. California Privacy Rights

In addition to disclosures made elsewhere in this Privacy Policy, certain states in the United States of America require us to disclose information related to our privacy practices. This section of our Privacy Policy (“California Privacy Policy”) serves to comply with the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”) (collectively, “CCPA”), and any capitalized terms defined in the CCPA have the same meaning when used in this Section.

16. Limitation Of Liability

To the extent permissible under the law, we shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, data, information, or other intangible losses (even if we have been advised of the possibility of such damages), arising out of this Privacy Policy.

17. Governing Laws And Disputes

This Privacy Policy will be governed by and construed under the laws of the Commonwealth of Pennsylvania, excluding choice of law provisions. Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, this Policy may be brought against either of the Parties in any of the courts of the Commonwealth of Pennsylvania. Each of the Parties consent to the jurisdiction of such courts (and of the appropriate appellate courts) in any such action or proceeding and waives any objection to venue laid therein.
